Chapter 7 Versus Chapter 13 Bankruptcy

Debtors generally file bankruptcy under three main Chapters: Chapter 7, Chapter 11, and Chapter 13. Individuals typically file a Chapter 7 or Chapter 13, whereas businesses generally file a Chapter 11 bankruptcy. The Chapter 7 is considered the debt liquidation bankruptcy; with this bankruptcy the bankruptcy trustee liquidates non-exempt assets and uses that money to make distributions to creditors. However, many Chapter 7 bankruptcies don't have "non-exempt assets" and are therefore considered "no asset bankruptcies," in which case the debtor keeps everything.

With a Chapter 7, certain debts such as credit cards and medical bills are erased through the bankruptcy. While Chapter 7 is frequently the bankruptcy of choice, a debtor must pass the bankruptcy means test in order to qualify. Basically, if a debtor's monthly income is too high, he or she will have to file a Chapter 13, "debt reorganization" bankruptcy instead.

The Chapter 13 is much like debt consolidation, in which case the debtor pays off all or a portion of their debts over a 3 to 5 year time period. With a Chapter 13 the debtor can keep their home and their automobile, which makes it the preferable option if the debtor wishes to save their home from foreclosure.
